The basics

Kinako is a business management platform for independent professionals. By creating an account, you agree to these terms. If you don't agree, don't use the service. You must be at least 16 years old to use Kinako.

Your account

You are responsible for maintaining the security of your account and password, and for all activity that occurs under your account. We strongly recommend enabling two-factor authentication. Kinako cannot and will not be liable for any loss or damage from your failure to maintain the security of your account.

Your data

You own your data. Everything you create in Kinako — clients, projects, proposals, invoices, contracts, notes, files — belongs to you. We do not claim any intellectual property rights over your content. You can request a copy of your data, or request that we delete it, at any time by emailing us.

Client data and messaging

When you upload information about your clients, send proposals, contracts, invoices, welcome docs, intake forms, testimonial requests, or transactional emails or SMS through Kinako, you confirm that you have the authority to do so and that the recipients have agreed to be contacted by you. You are responsible for the content of those messages and for complying with any applicable rules (anti-spam, marketing, consumer protection, and privacy laws). Kinako is the messaging tool — you are the sender.

AI features

Some features use AI to generate drafts and summaries from the content you provide. AI output can be inaccurate, incomplete, or inappropriate. You are responsible for reviewing every AI-generated draft before sending it to a client or relying on it for any decision. We do not warrant the accuracy of AI output.

Free and paid plans

The free plan provides limited access to Kinako features. Paid plans are billed monthly or annually through Stripe and renew automatically until you cancel. AI usage that exceeds the included allowance on your plan may be billed as overage at the rates shown in your billing settings. You can cancel your subscription at any time from your billing settings — you will retain access to paid features until the end of your current billing period. Except where required by law, we do not offer refunds for partial billing periods.

Acceptable use

You agree not to use Kinako to:

  • Violate any laws or regulations
  • Send spam, unsolicited marketing, or messages to recipients who have not agreed to be contacted
  • Upload malicious files or attempt to compromise the service
  • Reverse engineer, scrape, or place excessive load on the service
  • Resell or redistribute Kinako as your own product
  • Use the service to harass, defraud, or infringe the rights of others

Service availability

We aim for high availability but do not guarantee 100% uptime. We may perform maintenance that temporarily interrupts service, and we may change, suspend, or discontinue features at any time. We will notify users in advance when reasonably possible.

Suspension and termination

We may suspend or terminate your account if you breach these terms, if your use of the service creates risk or legal exposure for Kinako or others, or if your account is inactive for an extended period. You may stop using Kinako at any time. On termination, your right to use the service ends immediately; we will delete your data on the timeline described in our Privacy Policy.

Limitation of liability

Kinako is provided “as is” and “as available” without warranty of any kind. To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising from your use of the service. Our total liability for any claim is limited to the amount you paid us in the 12 months preceding the claim. Nothing in these terms limits liability that cannot be excluded under applicable law (including, where relevant, consumer guarantees under the Australian Consumer Law).

Indemnity

You agree to indemnify and hold Kinako harmless from any claim brought by a third party (including your clients) arising from content you upload, messages you send through the service, or your breach of these terms.

Governing law

These terms are governed by the laws of Victoria, Australia. The exclusive jurisdiction for any dispute is the courts of Victoria, Australia, except where applicable law gives you the right to bring proceedings in your local jurisdiction.

Changes to these terms

We may update these terms from time to time. Significant changes will be communicated by email. Continued use of Kinako after changes constitutes acceptance of the updated terms.
